To be eligible for the subclass 820 visa, you must

  • Not had a visa refused or an application cancelled
  • Have a sponsor
  • Living in Australia when you apply
  • Not hold certain regional visas
  • Be of the valid age
  • Match relationship requirements
  • Match Australia health requirement
  • Match Australia character requirement
  • Have no debt to the Australian Government
  • Be for the interests of the child.

If you have a specific regional visa, you might not be allowed to apply.
If you possess one or your most recent visa was one of the following:

  • Skilled – Independent Regional (Provisional) (Class UX) visa
  • Subclass 475 (Skilled – Regional Sponsored) visa
  • Subclass 487 (Skilled – Regional Sponsored) visa or
  • Skilled Regional Sponsored (Provisional) (Class SP) visa.

When you apply and when Australia decides whether to grant you a temporary visa, you must be present in Australia. You and your family members must both reside in Australia.

When you submit your application while you are on this visa, you and anyone else applying for the visa with you must have a sponsor.

Typically, your partner will be your sponsor.

Your sponsor needs Australia’s approval.

Your sponsor cannot be changed. When you apply for a visa, the sponsor must continue to sponsor you for two years after Australia issues your temporary partner visa (subclass 820).

For the 820 partner visa, you must be the spouse or de facto partner of an:

  • Australian citizen
  • Australian permanent resident or
  • eligible New Zealand citizen.

This is valid both for the application process and the decision-making process.

You can be dating someone of the same sex as you or someone different.

Married Applicants

  • If your marriage is recognized as legal under Australian law and:You and your partner are committed to each other above all else.
  • Your partnership is sincere and ongoing.
  • Either you live together or you don’t live apart forever.
  • You are not family relatives.

You should get in touch with the appropriate state or territory department for births, deaths, and marriages to find out if your union is recognized by Australian law.

De facto partner

You must be in a de facto relationship in order to be a de facto partner.

You and your partner are living together as a couple by de facto if:

  • You are not married to one another.
  • You and your de facto partner are committed to each other above all else.
  • Your partnership is sincere and ongoing.
  • You are not family relatives
  • You either live together or you don’t live apart permanently.

Before applying for this visa, you typically need to have been in a de facto relationship for at least 12 months. It’s possible that time spent dating or in an online connection doesn’t constitute time spent in a de facto partnership.

If you can convince us that you should be given a subclass 820 visa due to compelling and compassionate reasons, the 12-month requirement won’t apply.

Additionally, the 12 months requirements do not apply if:

  • Your spouse possesses or had a permanent humanitarian visa,
  • Your relationship was de facto before their visa was approved,
  • Before the visa was approved, your de facto partner disclosed the connection to Australia.

It also will not apply if:

  • You are in a de facto relationship with a partner who is an applicant for a permanent humanitarian visa, or
  • You have registered your relationship with an Australian authority such as a registry of marriages, births, and deaths.

Australian PR from the subclass 888 visa

Partner visa Subclass 801 (Permanent)

This visa enables the spouse or de facto partner of an Australian citizen, Australian permanent resident, or eligible New Zealand citizen to reside permanently in Australia. Typically, it is only available to those who currently possess a temporary Partner visa (subclass 820).

It's a permanent visa, you receive permanent residency on the day you are granted the visa.

  • Be a holder of a temporary partner visa (subclass 820) or dependent child visa (subclass 445)

  • Maintain a sincere and continuous relationship with your sponsor in most circumstances.

To be eligible for the subclass 801 visa, you must

You must:

  • Comply with visa requirements
  • Continue to match relationship requirements
  • Have no debt to the Australian government, or have arranged to pay all debts back.

You must be a holder of:

  • A Partner visa (subclass 820) or
  • A Dependent Child (subclass 445) visa.

For you to be assessed for the permanent visa, 2 years must have passed since you applied for the combined 820 and 801 visa.
If your sponsor already had a specific visa when you applied or if you were in a long-term relationship, you might receive the permanent visa in less than 2 years.

You must continue the spousal or de facto relationship with your partner who sponsored you.

You have to

  • Be married or living together as a couple
  • Maintain a sincere and ongoing relationship
  • Live together, or don’t live apart permanently

You must have paid the Australian government any money you owe, or have an approved plan in place to do so, if you or any family members (including those who don’t apply for the visa with you) do.

You may not be granted the visa if it’s not for the best interest of participants under 18.
